TERMS OF SERVICE

1. ACCEPTANCE OF THESE TERMS
These Terms of Service govern access to and use of Donaify. By visiting the platform, creating an account, creating or managing a campaign, making a donation, or otherwise using Donaify, you agree to these Terms and to the policies linked on the platform. If you do not agree, do not use Donaify.
2. THE DONAIFY PLATFORM
Donaify is an online technology platform that allows eligible organizers to present fundraising campaigns and allows donors to support eligible causes. Donaify is not a charity, bank, investment service, payment institution, or escrow provider. Donaify does not guarantee that a campaign, organizer, beneficiary, donation, payment, or payout will meet a user's expectations.
3. ELIGIBILITY AND ACCOUNTS
You must provide accurate, current, and complete information and keep it updated. You are responsible for activity under your account and for safeguarding your login credentials. You must not create an account for another person without authority, use false information, impersonate another person, or use the platform for an unlawful purpose.
4. CAMPAIGNS AND ORGANIZER RESPONSIBILITIES
Organizers are responsible for campaign content, the truthfulness of all claims, obtaining necessary permissions, identifying beneficiaries accurately, using funds consistently with the stated purpose, and complying with applicable law. Donaify may request documents or clarification before or after publication and may edit, pause, reject, remove, or limit a campaign where necessary to protect users or the platform.
5. DONATIONS
Donations are voluntary and are generally final once processed. Donaify does not guarantee campaign outcomes, delivery of benefits, use of funds, or a tax deduction. Before donating, users should review campaign information carefully and make their own decision. Limited refunds may be considered where there is an unauthorized payment, duplicate payment, processing error, confirmed fraud, serious policy violation, or another circumstance required by law or a payment provider.
6. PAYMENTS, FEES, AND PAYOUTS
Payments and payouts may be processed by third-party providers and remain subject to their rules, review processes, and availability. Platform fees, processing fees, or other applicable charges will be disclosed where required. Payouts may be delayed, limited, withheld, reversed, or refused where verification, fraud prevention, legal obligations, disputes, chargebacks, reserves, or provider requirements apply.
7. VERIFICATION AND COMPLIANCE
Donaify may request identity, organization, bank, ownership, authority, campaign, or source-of-funds information. Users must provide accurate information and cooperate with reasonable verification requests. Failure to do so may result in a campaign or account being restricted, suspended, or closed.
8. PROHIBITED USE
You must not use Donaify for fraud, deception, money laundering, terrorist financing, sanctions evasion, illegal goods or services, harassment, exploitation, hate, violence, intellectual-property infringement, gambling, investments, or any activity prohibited by applicable law or Donaify policy. You must not interfere with the platform, attempt unauthorized access, test payment cards, manipulate campaigns, or misuse another person's information.
9. CONTENT AND INTELLECTUAL PROPERTY
You retain responsibility for content you submit and confirm that you have the right to use it. By submitting content, you grant Donaify a non-exclusive, worldwide, royalty-free license to host, display, reproduce, adapt, and distribute that content as needed to operate, promote, and improve the platform. Donaify and its platform materials are protected by applicable intellectual-property laws.
10. SUSPENSION AND TERMINATION
Donaify may suspend, restrict, remove, or terminate access to an account or campaign where it reasonably believes that these Terms or a policy have been breached, a user presents a security or fraud risk, information is inaccurate, or action is necessary to comply with a legal or provider obligation. Users remain responsible for obligations incurred before termination.
11. DISCLAIMERS AND LIMITATION OF LIABILITY
The platform is provided on an as-available basis. To the maximum extent permitted by law, Donaify disclaims warranties that are not expressly stated in these Terms. Donaify will not be liable for indirect, incidental, special, consequential, or punitive damages, or for losses arising from user content, campaign outcomes, third-party services, payment-provider decisions, or events outside its reasonable control.
12. INDEMNITY
You agree to indemnify and hold harmless Donaify and Omni Spectrum Limited from claims, losses, liabilities, and expenses arising from your content, campaign, donations, use of the platform, or breach of these Terms, except to the extent caused by Donaify's own misconduct.
13. CHANGES TO THE PLATFORM OR TERMS
Donaify may change, suspend, or discontinue platform features and may update these Terms from time to time. Updated Terms will be posted on the platform with a revised effective date. Continued use after an update means you accept the updated Terms.
